1. Definitions

For the purposes of these Terms and Conditions, the following terms shall have the meanings ascribed to them below:

"Barangay" refers to Barangay Uwisan, including its duly elected officials, appointed employees, and authorized representatives who operate and maintain the System.

"System" encompasses the Barangay Uwisan Information Dissemination Management System and all related digital services, web applications, mobile applications, and technological platforms operated by the Barangay for information distribution and communication.

"User" means any individual, whether a resident, visitor, or authorized representative, who accesses, subscribes to, or utilizes the System for receiving information or accessing services.

"Resident" denotes a bona fide resident of Barangay Uwisan who maintains a permanent or temporary residence within the barangay's territorial jurisdiction.

"Services" includes all information dissemination services, announcement delivery, notification systems, and communication features accessible through the System, including but not limited to news updates, emergency alerts, event announcements, public advisories, and community information.

"Content" refers to all information, data, announcements, notifications, text, images, files, documents, multimedia materials, and communications available through, stored in, or transmitted via the System.

"Personal Data" means any information relating to an identified or identifiable individual, as defined under the Data Privacy Act of 2012 (Republic Act No. 10173) and its implementing rules and regulations.

"Administrator" refers to authorized barangay officials and staff responsible for creating, managing, and disseminating information through the System.

2. Eligibility and Scope

The System is designed and intended for use by residents of Barangay Uwisan, stakeholders, and the general public seeking access to official barangay information and announcements. To be eligible to register for personalized services, you must be at least eighteen (18) years of age or have obtained proper parental or guardian consent if you are a minor.

The Barangay reserves the absolute right to verify your identity and residency status when necessary, particularly for services requiring authentication or personalized information delivery. By using the System, you expressly confirm that you have the legal authority and capacity to provide information on your behalf or on behalf of those you represent.

Access to public information through the System is generally available without registration, in accordance with transparency and public information principles. However, certain features requiring personalized notifications or subscriber-specific services may require account creation and verification.

The Barangay may restrict or deny access to any individual who violates these Terms and Conditions or engages in activities that compromise the integrity, security, or proper functioning of the System.

3. Account Registration and Management

To access personalized features of the System, including customized notifications and subscriber preferences, you must complete the registration process by providing accurate, complete, and current information as requested. You are solely responsible for maintaining the confidentiality and security of your login credentials, including your username and password.

You agree to immediately notify the Barangay of any unauthorized use of your account or any other breach of security. You acknowledge and agree that you are fully responsible for all activities that occur under your account, whether authorized by you or not.

You must promptly update your personal information, particularly contact details, whenever changes occur to ensure you receive timely and accurate information from the Barangay. The creation of multiple accounts by a single individual without legitimate purpose is strictly prohibited and may result in immediate termination of all associated accounts without notice.

The Barangay reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice, for any reason deemed necessary to protect the integrity of the System, prevent abuse, or comply with applicable laws and regulations.

4. Information Services and Availability

The System provides comprehensive access to various barangay information and communication services, including but not limited to:

• Official announcements and public advisories
• Emergency alerts and disaster preparedness information
• Community events and programs
• Public health and safety notifications
• Government services information
• Meeting schedules and agendas
• Document availability notices

These services are provided to enhance transparency, improve communication between the Barangay and its constituents, and ensure timely dissemination of important information for the benefit of the community.

All services are provided on an "as is" and "as available" basis, subject to system maintenance, technical limitations, and operational requirements. The Barangay makes no warranties or representations regarding the uninterrupted availability of services, and users acknowledge that temporary service interruptions may occur due to maintenance, upgrades, technical issues, or circumstances beyond the Barangay's control.

The Barangay reserves the absolute right to modify, suspend, or discontinue any service or feature of the System at any time, with or without notice, for operational, legal, or security reasons. The Barangay strives to provide advance notice of planned maintenance or significant changes whenever feasible.

5. Information Accuracy and Updates

The Barangay endeavors to provide accurate, timely, and reliable information through the System. However, information is subject to change, and the Barangay does not guarantee the completeness, accuracy, or timeliness of all information disseminated through the System.

Users should verify critical information, particularly time-sensitive announcements or emergency information, through official barangay channels or by contacting the Barangay Office directly. The Barangay is not liable for decisions made based solely on information obtained through the System without proper verification.

Information posted on the System represents official barangay communications at the time of posting. The Barangay reserves the right to update, correct, or remove information as circumstances change or as errors are identified. Users are encouraged to check the System regularly for updates and to ensure they have the most current information.

6. Acceptable Use Policy

You may only use the System for lawful purposes and in strict accordance with these Terms and Conditions, applicable laws, and regulations. The System is intended for accessing official barangay information and legitimate communication purposes.

You are expressly prohibited from engaging in any of the following activities:

• Submitting false, misleading, or fraudulent information
• Attempting to bypass security measures or compromise the System's integrity
• Using automated systems, bots, or scrapers to access the System without explicit permission
• Interfering with the proper functioning of the System or other users' access
• Distributing spam, malware, or harmful content through the System
• Impersonating barangay officials, staff, or other users
• Using the System to harass, threaten, or harm others
• Attempting to gain unauthorized access to System features, data, or administrative functions
• Redistributing barangay information in a manner that misrepresents its source or context
• Using contact information obtained through the System for unauthorized commercial purposes

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account, legal action, and referral to appropriate law enforcement authorities. The Barangay reserves the right to monitor System usage and take appropriate action against any user who violates these terms.

7. Data Collection and Processing

The Barangay collects personal data that is necessary and relevant for providing information dissemination services, managing subscriber preferences, and fulfilling governmental communication functions. This data collection is conducted in accordance with the Data Privacy Act of 2012 (Republic Act No. 10173) and its implementing rules and regulations.

Personal data collected may include:

• Name and contact information (email address, phone number)
• Residency information
• Communication preferences and notification settings
• Usage data and interaction with System content
• Device and browser information for technical purposes

You warrant and represent that all information you provide to the System is accurate, complete, and up-to-date. The Barangay reserves the right to verify any submitted information through various means deemed necessary for the integrity of the System.

Personal data is retained in accordance with applicable laws, regulations, and operational requirements. You may opt out of receiving non-essential communications at any time through your account settings or by contacting the Barangay Office. Emergency alerts and critical public safety information may be sent to all registered users regardless of subscription preferences.

8. User Rights and Responsibilities

As a user of the System, you have certain rights regarding your personal data, including:

• The right to correct inaccurate or incomplete data
• The right to request deletion of your personal information, subject to legal and operational requirements
• The right to object to certain data processing activities
• The right to data portability where technically feasible
• The right to lodge complaints with the National Privacy Commission

In exercising these rights, you must cooperate fully with the Barangay's verification processes and provide any requested documentation or information necessary to process your requests. You are responsible for ensuring that any requests for data access, correction, or deletion are made through proper channels and in accordance with established procedures.

You are responsible for:

• Maintaining the accuracy of your contact information
• Managing your notification preferences
• Protecting your account credentials
• Reading and staying informed about barangay announcements
• Reporting any technical issues or security concerns promptly

The Barangay will respond to your requests in a timely manner and in accordance with applicable data protection laws. However, certain requests may be subject to legal limitations or operational constraints, and the Barangay reserves the right to deny requests that are not properly substantiated or that conflict with legal obligations.

9. Intellectual Property Rights

All content, logos, trademarks, announcements, and materials within the System are owned by the Barangay or used with proper authorization and permission. This includes but is not limited to text, graphics, images, videos, software, designs, and other intellectual property.

You may share barangay announcements and public information for non-commercial, informational purposes, provided that:

• You clearly attribute the information to Barangay Uwisan
• You do not alter, modify, or misrepresent the content
• You do not use the information for commercial purposes without permission
• You include a link or reference to the original source when feasible

You may not reproduce, distribute, modify, or create derivative works of Barangay branding, logos, or proprietary materials without explicit written authorization. Barangay trademarks and official seals may not be used without express written permission from the Barangay.

The Barangay grants users a limited, non-exclusive, non-transferable license to access and use the System for its intended purposes. This license does not include any right to use Barangay intellectual property for commercial purposes or in any manner that could be construed as endorsement by the Barangay.

10. Third-Party Content and Links

The System may contain links to third-party websites, services, or content for informational purposes or to facilitate access to related services. The Barangay does not endorse, control, or assume responsibility for any third-party content, and users access such content at their own risk.

Third-party services integrated with the System (such as notification services, mapping services, or social media platforms) are governed by their respective terms of service and privacy policies. Users are encouraged to review the terms and policies of any third-party services they interact with through the System.

The Barangay is not responsible for the availability, accuracy, or content of third-party websites or services, and the inclusion of links does not imply endorsement or affiliation unless explicitly stated.

11. Security and Privacy

The Barangay implements appropriate technical and organizational security measures to protect personal data against unauthorized access, alteration, disclosure, or destruction. These measures include:

• Encryption of data in transit and at rest
• Access controls and authentication mechanisms
• Regular security assessments and updates
• Staff training on data protection practices
• Incident response and breach notification procedures

In the event of a data breach that may affect your personal information, the Barangay will notify affected users in accordance with applicable laws and regulations, including the Data Privacy Act of 2012. Notifications will include information about the nature of the breach, potential consequences, and recommended protective measures.

You are responsible for taking reasonable steps to protect your account credentials and personal information. You must immediately report any suspected unauthorized access or security concerns to the Barangay Office. The Barangay maintains audit logs and monitoring systems to detect and prevent unauthorized access or misuse of the System.

However, no system is completely secure, and users acknowledge that they use the System at their own risk. The Barangay cannot guarantee absolute security and is not liable for unauthorized access resulting from circumstances beyond its reasonable control.

12. Emergency Communications and Critical Alerts

The System may be used to disseminate emergency information, disaster alerts, and critical public safety announcements. During emergencies, the Barangay may prioritize certain types of communications and temporarily modify normal operating procedures to ensure effective information delivery.

Users who have registered for notifications acknowledge that emergency alerts may be sent via multiple channels (SMS, email) and may be delivered outside of normal communication preferences to ensure public safety.

While the Barangay strives to provide timely and accurate emergency information, users should not rely solely on the System for emergency communications. Users should maintain multiple sources of emergency information and follow established emergency protocols provided by local authorities.

The Barangay is not liable for delays, failures, or inaccuracies in emergency communications caused by technical failures, force majeure events, or circumstances beyond its reasonable control. Users are encouraged to have alternative means of receiving emergency information.

13. Liability and Disclaimers

The Barangay provides the System and its services on an "as is" and "as available" basis. The Barangay disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

The Barangay is not liable for:

• System downtime, data loss, or service interruptions
• Technical issues beyond its reasonable control
• Inaccuracies or errors in disseminated information
• Decisions made based on information obtained through the System
• Damages resulting from reliance on System information without verification
• Third-party content or services accessed through the System
• Delays or failures in emergency communications
• Unauthorized access resulting from user negligence

Users are solely responsible for their actions and any consequences thereof, including any damages or losses resulting from their use of the System. Users should verify important information through official channels and exercise appropriate judgment when acting on information received through the System.

To the maximum extent permitted by law, the Barangay's liability is limited to direct damages not exceeding one hundred pesos (₱100). This limitation applies regardless of the legal theory on which the claim is based and whether the Barangay has been advised of the possibility of such damages.

14. Termination and Suspension

You may terminate your account and unsubscribe from services at any time by accessing your account settings or contacting the Barangay Office. Upon termination, you will cease to receive personalized notifications and communications, though you may still access public information available through the System.

The Barangay reserves the right to suspend or terminate accounts that:

• Violate these Terms and Conditions
• Engage in fraudulent or abusive activities
• Pose a threat to System security or integrity
• Remain inactive for extended periods (as defined by Barangay policy)
• Are created with false or misleading information

Upon termination, your access to personalized features will cease immediately, but certain data may be retained as required by law, regulation, or operational necessity. You may appeal termination decisions by contacting the Barangay Office, and such appeals will be reviewed in accordance with established procedures.

Termination of your account does not affect any obligations or liabilities that accrued prior to termination.

15. Dispute Resolution and Governing Law

Any disputes arising from these Terms and Conditions or your use of the System should first be addressed through informal communication with the Barangay Office. The Barangay is committed to resolving disputes fairly and efficiently through dialogue and mutual understanding.

If informal resolution fails, parties may agree to mediation through a mutually acceptable mediator. Legal action, if necessary, may be pursued in the appropriate courts of the Philippines. These Terms are governed by and construed in accordance with Philippine law, without regard to conflict of law principles.

Users are encouraged to contact the Barangay Office for assistance with any concerns or issues related to the System or these Terms and Conditions before pursuing formal dispute resolution.

16. Force Majeure and Emergency Situations

The Barangay shall not be liable for any delays or failures in performance caused by force majeure events, including but not limited to:

• Natural disasters (typhoons, earthquakes, floods)
• Government actions or declarations of emergency
• Power outages or telecommunications failures
• Cyber attacks or security incidents
• Pandemics or public health emergencies
• Civil unrest or armed conflict
• Other events beyond the Barangay's reasonable control

During force majeure events, the Barangay may implement special procedures, temporarily modify services, or prioritize certain types of communications to ensure public safety and effective emergency response. Users will be notified of significant service disruptions when possible and practicable.

The Barangay will make reasonable efforts to restore normal services as soon as possible following any force majeure event and will communicate with users regarding service status and any alternative arrangements that may be available.

17. Amendments and Updates

The Barangay reserves the right to update these Terms and Conditions to reflect operational changes, legal requirements, regulatory updates, or improvements to services. Users will be notified of significant changes through the System, email, website notices, or other appropriate means.

Continued use of the System after such changes constitutes acceptance of the updated Terms and Conditions. If you do not agree with the modified terms, you should discontinue use of the System and may contact the Barangay Office to terminate your account.

The current version of these Terms and Conditions is always available in the System, and the version number and effective date are clearly indicated. Previous versions are maintained for reference purposes in accordance with applicable record-keeping requirements.

18. Compliance and Legal Requirements

These Terms and Conditions comply with applicable Philippine laws, including:

• Data Privacy Act of 2012 (Republic Act No. 10173)
• E-Commerce Act of 2000 (Republic Act No. 8792)
• Cybercrime Prevention Act of 2012 (Republic Act No. 10175)
• Local Government Code of 1991 (Republic Act No. 7160)
• Freedom of Information Executive Order No. 2 (s. 2016)

The System operates in accordance with relevant government regulations, policies, and barangay ordinances. The Barangay may conduct audits to ensure compliance with these Terms and Conditions, and suspected violations may be reported to appropriate authorities.

Users are expected to comply with all applicable laws and regulations when using the System. The Barangay cooperates with law enforcement and regulatory authorities as required by law.

20. Severability and Waiver

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

The failure of the Barangay to enforce any provision of these Terms and Conditions, or to exercise any right or remedy available under these Terms, does not constitute a waiver of that provision, right, or remedy, nor does it preclude the Barangay from enforcing such provision or exercising such right or remedy in the future.

These Terms and Conditions constitute the entire agreement between you and the Barangay regarding the System and supersede all prior agreements, understandings, communications, and representations relating to the subject matter hereof, whether oral or written.

21. Special Provisions for Government Services

The System is provided as a public service and is subject to government regulations, policies, and procedures. As a government information system:

• Certain information may be subject to public records laws and disclosure requirements
• The Barangay operates the System in accordance with its public service mandate
• Government liability is limited as provided by applicable laws
• The System may be used to fulfill transparency and accountability obligations
• Information disseminated through the System is considered official barangay communication

During emergencies or disaster situations, special procedures may apply, and the Barangay may implement additional security measures, access restrictions, or communication protocols as deemed necessary for public safety and effective emergency management.

22. Accessibility and Accommodation

The Barangay is committed to making the System accessible to all users, including those with disabilities. The System is designed with consideration for accessibility standards and guidelines to ensure usability by the widest possible audience, including users with visual, auditory, motor, or cognitive disabilities.

Users with disabilities may request reasonable accommodations to access and use the System effectively. Alternative methods of accessing barangay information and services are available for users who cannot use the System due to accessibility barriers or technical limitations.

23. Language and Translation

These Terms and Conditions are originally drafted in English. If translated into other languages for user convenience, the English version shall prevail in case of any discrepancies or disputes regarding interpretation.

Information disseminated through the System may be available in multiple languages to serve the diverse population of Barangay Uwisan. While the Barangay strives for accuracy in translations, the official version of all announcements and information is the version in the language designated by the Barangay.

24. Feedback and Suggestions

The Barangay welcomes feedback, suggestions, and comments about the System and its services. By submitting feedback, you grant the Barangay a non-exclusive, royalty-free, perpetual license to use, modify, and implement such feedback without any obligation to compensate you or provide attribution.

Feedback can be submitted through the System's feedback mechanism or by contacting the Barangay Office directly. The Barangay values user input and uses it to continuously improve services and user experience.

These Terms and Conditions are effective as of the date of your acceptance and continue in effect until terminated in accordance with the provisions herein. Previous versions are available upon request for reference purposes.

All changes to these Terms and Conditions are documented and maintained in accordance with applicable record-keeping requirements. Users are responsible for reviewing these Terms and Conditions periodically to stay informed of any updates or modifications.

The version history and change log are maintained by the Barangay and available upon request for transparency and accountability purposes.
